Lease Driver Class Action Suit Against C.R. England
On May 27, 2011, the California law firm of
Lagarias & Boulter LLP filed a
federal class-action lawsuit on behalf of Charles Roberts and Kenneth McKay and
similarly situated former and current lease drivers against Defendants C.R.
England, Inc. and Horizon Truck Sales and Leasing, LLC. The case was filed in
the Northern District of California but transferred to the District of Utah in
April 2012. In April 2012, the law firms of Kravit, Hovel & Krawczyk S.C. of
Milwaukee, WI 53202 and Pia Anderson Dorius Reynard & Moss of Salt Lake City, UT
associated on the case as class action counsel for the plaintiffs and proposed
class.
The suit charges that C.R. England and Horizon Trucks Sales and Leasing engaged
in a fraud scheme to defraud class members out of money and labor via the lease
driver program. Among other claims, the class-action complaint alleges that C.R.
England and Horizon Trucks Sales and Leasing used false income statements and
failed to disclose the high failure/turnover rate to secure class members’
agreement to become lease drivers. C.R. England also deceptively sought lease
drivers by baiting the general public with advertisements for “guaranteed”
employee “company driver” positions and then used fraudulent and manipulative
techniques to switch candidates into the lease driver program. Plaintiffs
Charles Roberts (Roberts) and Kenneth McKay (McKay) were among many victims of
C.R. England’s fraudulent scheme. Copies of the complaint are available in the
